PHARMACHIEVE PRIVACY POLICY

PharmAchieve Corporation Ltd. (“PharmAchieve”, "we", "us" or "our") is a corporation formed pursuant to the Business Corporations Act in Ontario, Canada. Further to our terms of use (https://qbank.pharmachieve.com/terms.php) (the “Terms”), this Privacy Policy sets out how we collect, store and use personal information and cookies. Unless otherwise indicated, any capitalized terms in this Privacy Policy have the same meaning attributed to them in our Terms.

By agreeing to our Terms or by using the PharmAchieve Platform or our services, you consent to the collection and use of personal information in accordance with this Privacy Policy, which we may update from time to time.

PART I: COLLECTION OF PERSONAL INFORMATION

The Personal Information of Other Individuals

To the extent you (or your users) provide us with, or upload data that includes the personal information of another individual, you represent and warrant that you have that individual’s consent to provide us with their information to use in accordance with this Privacy Policy and our Terms. If you do not have their consent, you agree not to upload or provide us with any such personal information.

To establish an account with us or use the PharmAchieve Platform, we may collect the following personal information (whether you are a faculty member, student or otherwise):

  1. Full legal name;
  2. Address;
  3. Email address;
  4. Phone number;
  5. Banking and/or credit card information;
  6. Your school, university, college or institutional affiliation;
  7. Your status as either a student, faculty member or instructor on our platform;
  8. Comments, feedback, reviews and other information you upload or provide to the PharmAchieve Platform;
  9. Internet protocol (“IP”) address and location data, including geo-location data and IP analytics;
  10. Website, web browser, device and operating system data and signals as well as analytics regarding your use of the PharmAchieve Platform;
  11. Error reporting data (sometimes called crash reports) and hardware settings;
  12. Other types of raw data relating to how you interact with the PharmAchieve Platform, for example, your browser information and session duration, liveness and usage;
  13. Academic records including assessment data, grades, course progress and completion, issued certificates and related data;
  14. Profile photos (where you elect to upload them);
  15. Survey data, including that required by accreditation bodies;
  16. PEBC ID; and
  17. All other information you provide to us, whether on the PharmAchieve Platform or otherwise.

Payment Processing

We may also collect credit card and payment information from you via a third-party payment processor. As of the last date this Privacy Policy was updated, we use PayPal Canada Co., Shopify, Inc. and their subsidiaries and related entities worldwide, with their privacy statements are available at https://www.paypal.com/ca/webapps/mpp/ua/privacy-full?locale.x=en_CA#PayPal and https://www.shopify.com/ca/legal/privacy?country=ca&lang=en

Although we may display or link to their forms on the PharmAchieve Platform, when you provide your payment details, you are providing them to the applicable payment processor. You acknowledge that our third-party payment processors may have their own agreements which apply to you. While we will not have access to your entire credit card number, we will be able to bill your credit card and may have access to certain card and payment details such as the PayPal account / name, the name on your card, the transaction ID and billing address. PART II: THE USE OF PERSONAL INFORMATION

We do not sell personal information to third-parties. However, we may use personal information to:

  1. Facilitate the operation of the PharmAchieve Platform and our courses, including sharing or providing access to personal information to Third-Party Providers, see below for details;
  2. Bill and collect money owed to us;
  3. Verify your contact information;
  4. Provide user support or to support and improve the PharmAchieve Platform;
  5. Communicate with you about your account or courses or services we offer;
  6. Send or display informational and promotional materials from us. You may unsubscribe from such communications at any time by following the ‘unsubscribe’ link in the footer of such emails;
  7. Pursue available legal remedies to us and to prosecute or defend a court, compliant, hearing, arbitration or similar proceeding;
  8. Meet legal requirements or seek legal advice from a lawyer in connection with your use of the PharmAchieve Platform or courses;
  9. Submit tax information to the Canadian Government (for example, the information in T2202 tax slips);
  10. Watermark digitally downloaded materials;
  11. Enhance the security of the PharmAchieve Platform, detect and prevent fraud, and identify unauthorized account access or sharing.
  12. Support and enforce compliance with our Terms and applicable laws, rules and regulations;
  13. Provide academic reports to the college, university, or institution that arranged or paid (in whole or in part) for your account on the PharmAchieve Platform or requested that you subscribe to the PharmAchieve platform;
  14. Respond to remarks, reviews, or posts (whether made publicly or not) that we deem misleading, incomplete, inaccurate, unjust, or defamatory and you consent to disclosure of personal information that directly relates to the claims made to provide context, correct misinformation, or defend our reputation;
  15. Develop aggregated statistics (such as the average score for each question); and
  16. Meet the requirements of accreditation bodies for our accredited courses, including but not limited to issuing and verifying course completion certificates.

PART III: THE DISCLOSURE OF PERSONAL INFORMATION

Sharing Personal Information and Content if Required by Law

We may share personal information and any content collected, uploaded or provided to us if required by law, such as in response to a subpoena, court order or other legal process in any jurisdiction or to create and upload tax slips as required or permitted by law. If we are required by law to make any disclosure of your personal information or content, we may, but are not obligated to, provide you with written notice of such disclosure, if permitted by law.

Sharing Personal Information to Cooperate with Investigations, Law Enforcement, Regulatory Agencies and Other Authorities

Absent a court order, subpoena or other legal requirement to disclose personal information or content in our possession or control, you agree that we may also share personal information we collect from or about you and content you upload or which is associated with your account to cooperate with law enforcement authorities in the investigation of any criminal matter.

You agree that we may also report actual or suspected criminal acts, academic misconduct, misconduct, unethical act, plagiarism, or a breach or suspected breach of our Terms to appropriate authorities and regulatory agencies. Such authorities and regulatory agencies include, but are not limited to, self-governing professions or colleges you are or may seek to become a member of, or regulated by.

Text Messaging Data:

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of data sharing exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties other than our service providers who require it to send our text messages; for example for technical support or two factor authentication.

Sharing Personal Information with Third-Party Providers

Our suppliers, partners, independent contractors, including course instructors and site infrastructure operators (collectively “Third-Party Providers”) and/or employees, may have access to, or be shared personal information to use in connection with one or more of the purposes for which the information was collected.

Our Third-Party Providers may have access to personal information in providing services to us, or providing you with access to the PharmAchieve Platform or courses. We may use a variety of Third-Party Providers in order to host the PharmAchieve Platform and facilitate its ordinary use, including for example, hosting servers which store personal information.

As of the last revision date of this Privacy Policy, among others, we use the following Third-Party Providers who may have access to, or store your personal information, by virtue of our use of their services:

  1. Our email providers include Google LLC and Mailgun, together with their affiliated entities worldwide. For more information on their privacy practices, please see https://policies.google.com and https://www.mailgun.com/legal/privacy-policy; and
  2. Our data hosting and security providers include Google Cloud Canada Corporation, Catalyst IT (Canada), Sabil, Inc, Amazon Web Services, Inc. and their affiliates. We also use the following Third-Party Providers for email, content delivery, fonts and data analytics, and storage, among other things, in connection with your use of the PharmAchieve Platform, including Mailgun Technologies, Dropbox, Inc., Sabil, Inc. and Google LLC, together with their affiliated entities worldwide.

We may update the above list of Third-Party Providers from time to time as the PharmAchieve Platform and courses continue to evolve. Third-party providers may have their own agreements and privacy policies regarding the collection and use of personal information that we or you provide to them.

Your Personal Information May Be Stored in Multiple Jurisdictions

As we may have servers, devices, Third-Party Providers, employees and other parties we share your personal information with, locations both inside and outside of Canada, your personal information may become subject to foreign laws and foreign legal proceedings, including in countries that may have different data and privacy protections than Canada.

Sharing Personal Information if Our Business or Websites are Acquired

We may share personal information with our successors (if our business or the PharmAchieve Platform is acquired by another legal entity) or any assignee of our assets relating to the PharmAchieve Platform or courses. Disclosure in such circumstances is governed by the Personal Information Protection and Electronic Documents Act, SC 2000, c 5 in Canada.

Disclaimer and Warning About Sharing Personal Information Online

YOU ACKNOWLEDGE THAT WHEN SHARING PERSONAL INFORMATION ONLINE, THERE IS ALWAYS A RISK OF DATA BREACHES, INCLUDING DATA BREACHES IN WHICH THIRD PARTIES UNLAWFULLY ACCESS OUR SYSTEMS, OR THE SYSTEMS OF OUR THIRD-PARTY PROVIDERS, WHICH STORE PERSONAL INFORMATION.

WHILE WE TAKE MEASURES TO PROTECT PERSONAL INFORMATION, YOU AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, CONTRACTORS, AGENTS, THIRD-PARTY PROVIDERS OR LICENSORS BE LIABLE, HOWSOEVER CAUSED, INCLUDING BY WAY OF NEGLIGENCE, FOR THE LOSS OR THEFT OF YOUR PERSONAL INFORMATION OR ANY DAMAGES CAUSED AS A RESULT THEREOF, SO LONG AS WE WERE NOT DIRECTLY AND GROSSLY NEGLIGENT IN THE PROTECTION OF SAID INFORMATION.

Retention of Your Personal Information

We keep your personal information for as long as it is required for the purpose for which it was collected. There is no single retention period applicable to the various types of personal information collected. Please contact us if you would like to delete any personal information we hold about you following the termination of your account.

PART IV: Our Use of Cookies

By using the PharmAchieve Platform, you consent to our use of cookies. This cookies policy explains what cookies are, how we use them and how Third-Party Providers may also use cookies on, or in connection with the PharmAchieve Platform.

What are Cookies?

Cookies are small text files sent to and automatically downloaded by your web browser (assuming you have cookies enabled) when you visit the PharmAchieve Platform. A cookie file is stored in your web browser and allows the PharmAchieve Platform and Third-Party Providers we use to recognize you, track your activity across our and other websites and is usually used in conjunction with logging your internet protocol (“IP”) address.

Cookies can be "persistent" or "session" cookies. Persistent cookies remain on your computer (in your browser files) or mobile device when you go offline, while session cookies are deleted as soon as you close your web browser.

Can you block the use of Cookies?

Most web browsers allow you to disable the use of cookies. However, the PharmAchieve Platform or certain components of the PharmAchieve Platform may not operate properly, and you may not be able to access and use the PharmAchieve Platform if you disable cookies.

Can you delete Cookies once downloaded?

Most web browsers also permit you to delete cookies. This is typically done via your web browser’s settings, which vary depending on which web browser you use. For details on managing cookies settings using:

How we use Cookies

Our use of cookies is primarily for the security of the platform, for example to enable you to log into our systems, to carry over information from one page to the next, and to automatically log you out after a period of inactivity. For instance, when you supply your login credentials, we place a timestamped cookie on your computer which is how our site knows you are logged in. We also use cookies to analyze how you use the PharmAchieve Platform, for instance which pages you visit most often and where you found our websites online. This helps us better understand your user experience and to compile other statistics which we may use to provide a better user experience in future updates.

For example, cookies are used in connection with our use of Google LLC’s Google Analytics.
